The Legacy Release Program allows eligible refined petroleum underground storage tank owners or operators to be reimbursed up to $50,000 for 50% of eligible costs for correction action and/or indemnification costs incurred on or after December 30, 2014, in response to confirmed releases that were discovered and reported prior to December 30, 2014. The Legacy Release Program is funded by the Refined Petroleum Fund and the total amount expended cannot exceed $36 million for the life of the program, meaning that up to 720 claims may receive their maximum reimbursement limit.
For a claim to be approved, the requirements of Section 21510 of Act 451 must be met, including:
- The release from which the corrective actions or indemnification arose were discovered and reported prior to December 30, 2014.
- The UST systems(s) is/are presently in compliance with the registration requirements of Part 211, even if the current Owner or Operator is not the claimant.
- The Owner or Operator is not the United States Government.
The amount approved for reimbursement shall be 50% of the reasonable and necessary corrective action costs up to a maximum of $50,000 in reimbursement for all releases from all refined petroleum underground storage tanks systems at a single location.
